Title IX prohibits sex discrimination in any educational institution receiving federal funding (including private and public K-12 schools, community colleges, and a majority of universities). The U.S. Supreme Court and U.S. Department of Education have broadly interpreted Title IX’s scope to also prohibit sexual harassment and sexual assault. Title IX requires schools to take prompt action to investigate and remedy hostile learning environments. Failing to comply puts schools at risk of losing state and federal funding.

Under Title IX educational institutions must conduct an independent investigation into alleged violations, separate from an investigation conducted by law enforcement. With educational institutions coming under increased scrutiny for their handling of Title IX complaints, campus leaders face mounting pressure to ensure quality investigations and procedures.
